Terms of Service

1. Scope

These Terms apply to all contracts between the operator of EMP Tweaks (“Provider”, see Legal notice) and the customer for digital software licenses sold via https://emptweaks.com.

Customer terms do not apply unless the Provider agrees in writing.

2. Subject matter

You purchase a digital license for “EMP Tweaks” (Windows optimization software), including download of the program file and a KeyAuth license key (typically HWID-bound), when stock is available.

This is a digital product. No physical goods are shipped.

3. Contract formation & prices

Listings on the website are invitations to treat. A contract is formed when you complete Stripe Checkout and payment succeeds.

Prices are in EUR unless stated otherwise. Taxes (VAT/GST etc.) may be calculated via Stripe Tax and shown on the invoice.

Promo / streamer codes may reduce the price; there is no entitlement to any specific discount.

4. Delivery

After successful payment you receive the license key and download as soon as possible on the success page, and may receive invoice/receipt details by email via Stripe.

You must provide a valid email and keep your key and download secure.

5. Withdrawal for digital content

For digital content not supplied on a tangible medium, the right of withdrawal ends when performance begins after you expressly agree that performance may start before the withdrawal period ends and acknowledge that you lose the withdrawal right once performance begins (see § 356 (5) German Civil Code where applicable).

By checking the Terms checkbox and completing payment you give that consent. Key and download delivery starts immediately after payment.

6. No refunds

After successful payment and delivery of the key and/or download, there is generally no right to a refund, because this is immediately delivered digital content and withdrawal is excluded under section 5.

Mandatory statutory warranty rights remain unaffected. If delivery fails despite payment (e.g. missing key), contact support; re-issuing the key is the preferred remedy.

7. No performance or compatibility guarantee

EMP Tweaks changes system and possibly GPU/driver settings. We do not guarantee that the software works on every PC, Windows/driver version, game, or hardware setup, or that it produces measurable gains (e.g. FPS).

Results depend on hardware, drivers, background software, games, and other factors. Marketing claims and testimonials are non-binding.

8. Limitation of liability

Use is at your own risk. To the extent permitted by law, the Provider is not liable for:

• damage to hardware, software, OS, games, or peripherals,
• data loss, instability, bluescreens, boot issues,
• performance loss or conflicts with antivirus / anti-cheat,
• bans or restrictions by third parties (games, launchers, platforms),
• lost profit or indirect damages.

Liability for intent, gross negligence, injury to life/body/health, product liability, and other mandatory rules remains unaffected.

You should create backups/restore points before use and only run the software on systems you are allowed to modify.

9. License & HWID

The license key is usually bound to a hardware ID (HWID). Sharing, reselling, or publicly posting the key is prohibited unless expressly allowed.

HWID resets may be requested via support and are at the Provider’s discretion (abuse prevention).

10. Partners / streamers

Streamer promo codes and commissions may follow separate partner rules. The Provider may change or end codes and terms at any time.

11. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protections in your EU country of residence remain unaffected.

If any clause is invalid, the remaining terms stay in force.
